These Terms and Conditions govern your use of the CERTRCTR platform, website, and services. By accessing or using CERTRCTR, you agree to be bound by these terms. If you do not agree, do not use our services. We reserve the right to modify these terms at any time, and continued use after changes constitutes acceptance.
License and Permitted Use
CERTRCTR grants you a limited, non-exclusive, non-transferable license to access and use our platform for lawful purposes only. Prohibited activities include harassment, illegal activity, unauthorized access to protected areas (including admin routes), brute-force attacks, data scraping, reverse engineering, or misrepresenting your qualifications to employers. You may not reproduce, distribute, or transmit any content without written permission.
User Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and OTP authentication codes, and for all activity under your account. You agree to provide accurate, current information, not to share login information, and not to attempt to bypass security measures. CERTRCTR is not liable for unauthorized access resulting from your negligence.
User Content
You retain ownership of content you upload (resume, certifications, work history). By uploading, you grant CERTRCTR a non-exclusive, worldwide license to use, display, and share this content with employers for matching purposes. You represent that you have the rights to all content you submit and that it is accurate.
Employer Matching and Job Placement
CERTRCTR facilitates connections between candidates and employers. We do not guarantee job placement, interviews, or employment. Employers make independent hiring decisions. We are not responsible for employment outcomes or disputes between you and employers.
Certification Guidance
Our certification recommendations and career pathway tools are exploratory and informational only. They do not guarantee certification success, employment, or salary outcomes. Certification requirements and technology change rapidly. Verify all information independently.
Intellectual Property
All CERTRCTR content, including CERT* designations, badges, social media assets, generated materials, design, algorithms, and tools, remain the property of CERTRCTR or its licensors. You may use downloaded badges and assets solely for professional purposes in accordance with our branding guidelines. Resale or commercial redistribution is prohibited.
Third-Party Integrations
CERTRCTR integrates with Apollo and OpenAI services via MCP connections. Your use of these integrations is subject to their respective terms of service. CERTRCTR is not responsible for third-party service interruptions or their data handling practices.
Limitation of Liability
CERTRCTR is provided on an 'as-is' basis without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of the platform, including lost wages or employment opportunities. Our total liability is limited to the amount you paid for services in the past 12 months.
Indemnification
You agree to indemnify and hold harmless CERTRCTR from any claims, damages, or costs arising from your violation of these terms, misuse of the platform, or disputes with employers.
Termination
CERTRCTR may suspend or terminate your account for violations of these terms, including unauthorized access attempts or misuse of generated content. Upon termination, your right to use the platform ceases immediately.
Dispute Resolution and Arbitration
Any dispute arising from these terms shall first be addressed through good-faith negotiation. Unresolved disputes shall be resolved through binding individual arbitration, not class action or jury trial, except that either party may bring claims in small claims court where eligible. You may opt out of arbitration within 30 days of first accepting these terms by written notice.
Governing Law
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in California for any matters not subject to arbitration.
Changes to Terms
CERTRCTR reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of updated terms. We will notify users of material changes via email or platform announcement.
